Terms & Conditions

Welcome to Ganesh Tech Solution. These terms and conditions outline the rules and regulations for the use of our services.

1. Definitions

“Company” refers to Ganesh Tech Solution.

“Client” refers to the individual or organization receiving services.

“Project” refers to the work agreed between the company and the client.

“Agreement” refers to these terms & conditions.

2. Service Scope

Ganesh Tech Solution provides the following services:

• Website Development
• Mobile App Development (Hybrid/Native)
• Software Development
• Cybersecurity & IT Security Audits
• Cloud Services & Hosting Setup
• Graphics & Branding
• IT Infrastructure Setup
• AMC & Support Services

A detailed project scope will be provided in the quotation/proposal.

3. Quotation & Pricing

All quotations are valid for 15 days from the date of issue.

Prices are exclusive of GST (18% or applicable rate).

Any additional features or changes requested after project initiation will be treated as new work and charged separately.

MSME rules apply for timely payment release.

4. Advance & Payment Terms

50% advance payment is required to start the project (non-refundable).

30% on mid-project completion / preview delivery.

20% on final delivery before hosting/live deployment.

For AMC or subscription services, full payment is required in advance.

Payments must be made via UPI, bank transfer, or other approved methods.

5. Timeline & Delivery

Timeline will be mentioned in the official proposal.

Timeline may vary if:

• client delays content/materials
• scope changes
• additional requirements come

Ganesh Tech Solution is not responsible for delays caused by 3rd-party services (domain, hosting, API issues, etc.).

6. Revisions

Standard projects include 2 rounds of revisions.

Additional revisions are chargeable as per the company’s pricing policy.

7. Data & Content Responsibility

Client must provide all required content: text, images, videos, logos, documents, etc.

Client must ensure that all provided content is legal and does not violate copyright.

Ganesh Tech Solution is not liable for any content-related legal issues.

8. Hosting, Domain & Third-Party Charges

Domain & hosting charges are not included unless mentioned.

Third-party integrations (SMS, Email API, Payment Gateway, CDN, etc.) will be charged separately.

Renewal fees are the responsibility of the client.

9. Intellectual Property Rights

After full payment, all final deliverables (website, app, software) become the property of the client.

Source code ownership is decided based on contract:

• Open Source Code: provided after full payment
• Licensed Code: remains property of Ganesh Tech Solution

Company may showcase the project in portfolio, unless the client requests NDA.

10. Support & Maintenance

1 month free support is provided for bug fixing after project completion.

Support does NOT include:

• new features
• redesigning
• server migration
• third-party updates

AMC (Annual Maintenance Contract) can be purchased separately.

11. Cancellation & Refund

Advance payment is non-refundable.

No refund once the work has been initiated or delivered.

If client cancels the project, all completed work till date will be billed.

12. Confidentiality

Both parties agree not to share sensitive information with any third party.

Ganesh Tech Solution maintains confidentiality of client data at all times.

13. Liability

The company is not responsible for:

• data loss due to hosting/domain issues
• hacking caused by weak third-party server security
• misuse of project by client

Maximum liability is limited to the amount paid by the client.

14. MSME Compliance (If Registered)

As per MSME Act:

Client must release payment within 45 days.

Delayed payments may attract penalty interest as per MSME norms.

15. GST Compliance

GST invoice will be provided for all payments.

GST amount must be paid by the client as applicable.

Late fee or penalty (if any) due to wrong client details is client’s responsibility.

16. Modification of Terms

Ganesh Tech Solution reserves the right to update or modify these terms anytime. Updated terms apply to all ongoing and future projects.

17. Jurisdiction

Any dispute shall be addressed under the laws and courts of India.
